Terms and Conditions for Customers

1. Introduction

Welcome to Tech Africa Hire! We provide tool and plant hire services to our valued customers. By engaging with our services, you agree to the following terms and conditions. Please read them carefully before proceeding with any rental or purchase from our company or our associated vendors. These terms and conditions constitute a legal agreement between Tech Africa Hire and/or Tech Africa Hire’s Vendors and you, the customer. A “vendor” is an individual or company who listed their equipment for hire on the Tech Africa Hire website. Tech Africa Hire takes a commission for every hire that a vendor receives through our website. Tech Africa Hire and it’s vendors will be referred to throughout as “the supplier”.

2. Rental Agreement
2.1. All tool and plant rentals are subject to availability.
2.2. The rental period begins from the date and time the equipment is collected or delivered to your specified location.
2.3. Rental charges are based on the agreed-upon period and must be paid in full before the equipment is released.
2.4. You are responsible for inspecting the equipment upon receipt and verifying that it is in proper working condition.
2.5. The rental equipment must be returned in the same condition it was received, subject to reasonable wear and tear.
2.6 If the equipment is not returned or is not able to be collected on the original agreed date, the customer will pay the supplier an extended hire of fee of USD$200 in addition to the rental charge for the extended period.

3. Equipment Use and Maintenance
3.1. You agree to use the rented equipment for its intended purpose and in a safe and responsible manner.
3.2. Any modifications or alterations to the equipment are strictly prohibited.
3.3. Regular maintenance and care of the equipment during the rental period are your responsibility. In case of mechanical issues or breakdowns, please notify us immediately.

“4. Loss or Damage to Hire Goods

4.1 If the Hire goods are returned in a damaged, unclean and/or defective state, the customer shall be liable to pay the supplier for the cost of any repair and/or cleaning required to return the hire equipment to a state that is fit for rehire. The customer will be required to pay the associated rental cost to the supplier until the repairs and or cleaning has been completed.
4.2 If the hire goods are lost, stolen or damaged beyond economic repair, the customer will pay the supplier the new replacement cost for any hire goods within 1 month of the customer notifying the supplier. The customer will also reimburse the supplier for any loss or costs suffered or incurred by the supplier, this fee must be paid within 1 month of the customer notifying the supplier. In addition, the customer shall pay the supplier, as a genuine pre-estimate of lost rental profit, a sum as liquidated damages being equal to two thirds of the rental that would have applied for such hire goods during the lost rental period.

5. Security Deposit

5.1. A security deposit is required for all equipment rentals. The deposit amount will be specified at the time of the rental agreement.
5.2. The security deposit will be refunded upon the return of the equipment in satisfactory condition, less any applicable deductions for damages or outstanding fees.
5.3. Prior to the hire, Tech Africa will require a copy of your national identification. Failure to provide this can result in the hire not going ahead.

6. Delivery and Collection
6.1. Delivery and collection services are available upon request and may incur additional charges.
6.2. If the equipment is to be collected from our premises, you must arrange for suitable transportation and loading facilities.
6.3. The equipment must be returned to our specified location on or before the agreed-upon return date. If the equipment is to be collected by the supplier at the end of the hire, the customer should ensure that it is ready to be collected at the same location that the equipment was dropped off at. If the customer moves the hired equipment to a different location, they must inform the supplier. There may be an additional collection fee if the collection address differs to the delivery address. 

7. Insurance
7.1. You are responsible for insuring the rented equipment against loss, theft, and damage during the rental period.
7.2. Tech Africa Hire shall not be held liable for any loss or damage to personal property or any third-party claims arising from the use of our equipment.

8. Cancellation and Refunds
8.1. If you wish to cancel your rental order, please notify us at least 24 hours before the scheduled collection or delivery date.
8.2. Refunds for cancellations made within the specified time frame will be processed, excluding any applicable cancellation fees.

9. Liability
9.1. Tech Africa Hire shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use or non-availability of our equipment.
9.2. We shall not be responsible for any delays or failures in service due to circumstances beyond our reasonable control.

10. Governing Law
10.1. These terms and conditions shall be governed by and interpreted in accordance with the laws of Zimbabwe.
10.2. Any disputes arising from this agreement shall be subject to the exclusive jurisdiction of the courts in Harare, Zimbabwe.

11. Amendments
11.1. Tech Africa Hire reserves the right to amend or update these terms and conditions at any time without prior notice.
11.2. The most recent version of the terms and conditions will be posted on our website and will apply to all current and future rental agreements.
